Terms & Conditions for all members,sellers,bidders and guests;
Introduction;
Ozy Online Auctions reserves the rights to change or amend any or all parts of these and all other binding Terms & Conditions,Agreements,Privacy Policy, & Policies on Fraud at any time without prior warning to anybody. It will be up to you the members and guests to stay up to date with these terms & policies and we take no responsibility for your lack of knowledge of these Terms & Policies.
Eligibility of membership - This auction site is only available to people who are legally able to form binding contracts between the bidder and the seller of an auction item. People who are under the age of 18 are not eligible for membership due to security precautions that can result as of those members.
If you do not meet these requirements, you are not eligible to use these auction services.
Terms of Use;
Ozy Online Auctions Terms & Conditions will apply to all members, sellers, bidders and guests to the Ozy Online Auctions website exclusively. These Terms & Conditions must be read and accepted before joining Ozy Online Auctions as a member to be allowed to buy or sell any items on our website.
As far as Ozy Online Auctions is aware no Copyright infringements have been broken and if you believe that they have please email us at support@ozyonline.com.au. Ozy Online Auctions is an Australian based worldwide community auction site which we are more than happy to provide to all users for a very small fee in return, to both private and businesses alike so we hope that you will all use this site with the same respect and dedication that Ozy Online Auctions will give you.
We will not accept any type of Discrimination, Slander, Abuse whether it be to other members of Ozy Online Auctions or our Staff for any reason what so ever. All problems/disputes can and will be dealt with amicably at all times by both parties. Ozy Online Auctions will only ever serve as mediators in any and all disputes concerning buyers and sellers as we can not be held responsible and will not be held responsible for either the lack of buyers paying or the lack of sellers correctness of information to-wards their items. But we will do what ever we can to assist and insure both sellers and buyers get equal say and get treated both fairly and amicably by the other party involved.
Patents and Copyrights;
We believe that all material contained within Ozy Online Auctions is legal in all countries and that our websites design is in accordance with all copyright material.
Ozy Online Auctions Website design, Name, Features and all other material within Ozy Online Auctions is copyright and under no circumstances can it be Copied, Duplicated, Imitated, Distributed, Modify, Upload or Post any Items/Material in any way shape or form from Ozy Online Auctions website without the WRITTEN consent of Ozy Online Auctions Owners, Administration and/or Partners.
Some Contents/Items being sold on Ozy Online Auctions may be Patented and/or Copyright and these belong to their owners using them and for this reason we do not permit any coping of Items/Material used by sellers that is brought into the Ozy Online Auctions website for the purposes of selling their items. (This excludes all Items/Material and Features supplied by Ozy Online Auctions for the purposes of selling).
In the event that Patented and/or Copyright items/material is found it is to be taken up with the user that is using the Patented and/or Copyright items/material by the Owner of the Patented and/or Copyright Items/Material.
We advise the owner of the alleged Patented and/or Copyright Items/Material to contact Ozy Online Auctions support at sales@ozyonline.com.au first to inform us of such breaches and we will help in confirming if any breach has really been made before you the owner of the Patented and/or Copyright items/Material contact the user to avoid any unnecessary confrontation between the user and the owner of the Patented and/or Copyright Items/Material. (We may need proof that your item/Material is protected by Patent and/or Copyright laws accompanied with a signed letter from the owner of the Patented and/or Copyrighted Items/Material before any steps can be taken by Ozy Online Auctions staff).
However Ozy Online Auctions takes on responsibility for a users actions in using Patented and/or Copyright Items/Material and although we will help to resolve this issue between the two parties only as mediators (by request only in writing) take absolutely no responsibility for the misuse of Patented and/or Copyright Items/Material.
We do reserve the right to cancel a members Item/Items suspected of any breach or suspend and/or cancel any sellers/members that we find have breached any of these conditions without prior warning until the matter is resolved, (the member it concerns will then be notified by email of the suspension and/or cancellation of their item and/or account). It will be up to Ozy Online Auctions to determine the seriousness of the matter which will then determine how this matter will be dealt with in regards to reactivating that members account with Ozy Online Auctions.
The suspended/canceled member may plead his/her case in writing by email to Ozy Online Auctions support if they feel they have been wrongly accused in the use of the Patented and/or Copyrighted Items/Material.
All suspended members will have their accounts reinstated after a period on no less than 1 month after they have sent us a written statement, SIGNED that they will in the future comply with all the Term and Conditions of Ozy Online Auctions. All canceled members may reapply after one year (12 months) in writing with a SIGNED statement stating that they will comply with all of the Ozy Online Auctions Terms and Conditions. These Conditions are binding and all SIGNED statements will be kept on record permanently with any further breaches disallowing any future involvements with Ozy Online Auctions permanently.
Any suspended or canceled members found trying to sell or buy under another name or account will automatically be withdrawn without warning and the member that owns that account will him/her self be suspended as well.
Policies on Fraud;
Ozy Online Auctions will not tolerate any type of fraud from any country for any reason what so ever and all accounts, information, IP addresses and anything else relevant will be sent to the appropriate authorities for further investigation.
Ozy Online Auctions make no guarantees that a users information or identity is correct when they register with us and this is admittedly hard to track but any such offenders giving false information will be suspended instantly following further investigation.
Ozy Online Auctions keeps a record of all IP addresses for the purpose of matching them to the correct credit card details and personal details (kept on a separate computer) when payment transactions are made and therefore it is your duty as a user, member and/or seller to supply us with the correct details for the purpose of identification.
All such personal information is kept private and on a separate computer to our website and will never be passed on to third parties for any reason other than to any relevant authorities if involved with wrong doings such as fraud of any type and/or in the event they are requested by a member or seller to solve a dispute. It will be left up to Ozy Online Auctions as to whether or not the dispute requires personal information to be passed along and if in the event any personal information does need to be passed on it will be to both parties involved and it will only be accepted when applied for in writing via an email.
If a member is found committing any offenses and they are suspended for such offenses all auction bids placed by them, all items being sold by them, will be instantly ceased/canceled without warning with no refunds of any money or credits owing.
We at Ozy Online Auctions will not tolerate any type of fraud, attempts of fraud or anything to do with misleading another member for the purpose of obtaining either free items, money or personal information from another member or user of Ozy Online Auctions.
All Promotions;
Ozy Online Auctions at any time may hold or offer promotions or vouchers. These promotions will only be valid if they came from ads on our website, websites we advertise on, or in our newsletters. A copy will need to be kept unless otherwise stated in those ads or in our newsletters, (you may be required to supply either a link from which you saw the ad or a copy of the newsletter for verification). NO other forms of promotions will be accepted by Ozy Online Auctions for any reason what so ever. In other words if it didn't come from us it isn't ours and will not be complied with. We keep a record of where all our ads go and a record of all our newsletters for reference.
New Registering Members;
All users need to register to become a member of Ozy Online Auctions to be allowed to sell or buy anything. This is a requirement for accessing anything on Ozy Online Auctions other than just browsing.
Usernames & Passwords
All new registering members are asked to choose a Username & passwords which will allow them access to buy, sell and use their accounts.
These Usernames & passwords will be your responsibility to keep to yourself and should under no circumstances be given to anybody else to use.
If you suspect that your Username & passwords is being used on Ozy Online Auctions by someone else you should notify Ozy Online Auctions immediately so we can stop/cancel usage of that Username & passwords and investigate the matter. You will then be asked to supply us with a new Username which we will allocated to your account or you may op to cancel your account and re-register anew, this will be your decision.
Bidders;
Like any and all auctions to place a bid on any item means you have read and agree to all the Terms & Conditions that are set out by Ozy Online Auctions and also agree that you have engaged yourself into a legal binding contract with the seller of the item you are bidding on.
Once a bid is confirmed/accepted by you it cannot be retracted and you are obligated to pay for this item including it's postage fees set out by the seller. A seller will usually give buyers 3 to 5 working days to pay for an items unless it's a BUY IT NOW item where they do have the right to ask for payment at the time of clicking the BUY IT NOW button. Always read the sellers Terms of Sale before placing a bid as by bidding suggest that you have read them and you will be agreeing to their Terms of sale.
All failure to abide by these conditions will lead to a negative feedback by the seller and being reported to Ozy Online Auctions where we will decide action after contacting you for an explanation as to why you didn't abide by the Terms & Conditions of Ozy Online Auctions.
We are aware of the many tricks that can be used to avoid paying for items bid on and the main most common is closing ones account to avoid the sellers finding you, but please don't be mislead as to thinking that it will end there (the seller may not find you but we know who you are) as by using such measures to avoid paying for an item will lead your IP address to be permanently blocked from re-registering with Ozy Online Auctions ever again as this type of action will be constituted as a type of fraud and we at Ozy Online Auctions for the safety of everyone of our members will not tolerate any type of fraud what so ever no matter what the reason. Our duty is to insure that every member is treated equally and fairly within all aspects of using Ozy Online Auctions website. In the case of any disputes whether it be about items or payments with proof of just cause Ozy Online Auctions will allow the exchange of both parties contact details to each party provided by Ozy Online Auctions. We will also keep track of such disputes and upon request (in writing) act as mediators if asked to as long as the asking party understands that we will only be acting as mediators having no opinions or judgments on decisions made between both parties.
Having said this no one is perfect and human error is all to often something that is bound to happen. If a bid of any type or a BUY IT NOW button clicked on by mistake it is your duty to instantly contact the seller to inform them of the error and it will be left up to the sellers discretion as to whether they accept to remove your bid offer or let you cancel the BUY IT NOW transaction. Please understand that if the seller refuses to cancel any of these that you will be held liable to pay for the item and may receive a negative feedback from that seller. In most cases sellers are understanding and will work with you but we at Ozy Online Auctions cannot speak for everyone and accept no responsibility for the sellers decision.
Sellers;
By becoming a seller on Ozy Online Auctions you agree to be obligated in providing as much information as is necessary to accurately describe the item you are selling, this includes whether or not it is new or used, damaged or not, working or not, repairable or not, still under finance, the size of the item if it's to be posted or couriered, the postage fee either in the form of a set fee or ask to be contacted as it may depend on the area the bidder lives in, (NOTE; both the sellers at the time of placing listings and the items viewing page have postage calculators on them that can be access by clinking on the link which will open a separate window for you to work out a more accurate postage fee).
It is also your duty to allocate payment methods to your bidders, our system accepts Paypal and credit card payments through Paypal via email (as a seller you can either set this up yourself with Paypal free to setup or you may use ours which would allow us to take payment for you and be sent to you once payment was confirmed), (by using this email credit card nobody but Paypal gets to view any account details and the payment goes straight into your account no different to going into your bank account from a credit card transaction. This service is used by sellers that have buyers that don't have a Paypal account, the seller would then send an email to the winning bidder with this option of payment if the bidder chooses to pay by credit card at checkout). Please refer to your Paypal account for more details about this free to set up service to sellers.
As for Direct deposit details we feel this is best done by you the seller at the end of the auction if the bidder chooses to pay you via direct deposit. This will mean you will send the bidder your direct deposit bank details. If the demand for keeping such details on our system is called for then we may add it to our system.
All items placed for listing can only be done once you have paid for the featured fees. we have set up an auction site that doesn't have any final value fees and by doing so means that our only obligation to receiving payments from sellers is to post an item online so we have simplified the system even more by have those fees paid for at the time the item is listed. You the seller then has no other fee to worry about concerning Ozy Online Auctions. You will also never receive nasty e-mails asking for money by us.
Sellers you rely on buyers feedback to improve your sales so if you do the right thing by them then your good feedback history will look appealing to buyers as a trusted seller. Ozy Online Auctions will be in no way responsible or held responsible for any sellers lack of description and/or information supplied to bidders and any and all action taken by a bidder will be dealt with directly with the seller. In the case of any dispute and upon request with proven just cause Ozy Online Auctions will exchange both parties contact details to each party fairly and without prejudice.
Fees;
The only fees on Ozy Online Auctions is when listing/posting an item and placing advertising banners which you will need to pay for there and then. Once you have done so you will not be billed for using any other parts or our website.
Our Listing fees are as follows;
1 -- Listing fee = FREE
2 -- Bold = $0.50au
3 -- Category Featured = $1.50au
4 -- Front Page Featured = $2.00au
5 -- Front Page Gallery featured = $2.50au
6 -- Highlighted = $0.50au
7 -- Pictures = the first 3 pics are free and then it's $0.20au per pic after that. You can have up to 12 picutres in total.
You will ahve to cedit your account before starting to post items as these fees will be deducted from that acount. This excludes those sellers that are within the first 200 with 10 or more items listed.
For those sellers you will need to e-mail us to inform us of this intention and we will credit your account with $200.00au for you to list your 10 item minimum and when you have done this we will credit your account with the balance to a total of $2000.00au.
You can also create your own store free of charge.
We are committed to giving our members the best and cheapest service possible without going broke ourselves. If there is anything you feel you need or want to see on our website all you have to do is ask and we will endeavor to achieve this as fast as possible, this also includes any categories you may need or want that we don't have. they will be added for you anywhere from instantly if we are here to a few hours if we are busy.
Ozy Online Auctions will not be held responsible for improper information given to us by registering members.
